Additional Terms for Prize Competitions and Free Draws
These Terms govern the use of the specific Prize Competition and Free Draw functionality as part of GiveWheel.
These Additional Terms apply to Competition Hosts who create, manage, or promote Competitions on GiveWheel.

Introduction
These terms ("Additional Terms") apply to any individual, Company, Beneficiary Organisation, or other entity that creates, manages, or promotes a Competition, or otherwise offers entries to a Competition, through the Platform ("Competition Host", "you" or "your").
These Additional Terms supplement, and form part of, GiveWheel's main Terms of Service (the "Terms"). In the event of any conflict between the Terms and these Additional Terms, these Additional Terms take precedence in relation to your use of Competition functionality.
Nothing in these Additional Terms creates a partnership, joint venture, agency, fiduciary relationship or employment relationship between GiveWheel and a Competition Host.
Competition Rules means the rules, terms, conditions, closing date, entry requirements, eligibility criteria, Prize details, and other conditions specified by the Competition Host for a Competition.
Capitalised terms used but not defined in these Additional Terms have the meaning given to them in the Terms.
1. About Competitions
1.1. GiveWheel provides technology that enables Competition Hosts to create Competitions, manage entries, collect payments where applicable, and use Platform functionality to assist with winner selection and winner management.
1.2. GiveWheel is not the Competition Host of any Competition unless expressly stated.
1.3. GiveWheel provides the Competition platform only and is not responsible for organising Competitions, judging or selection criteria, cancellations, or fulfilment of Competition Host obligations. Further detail on GiveWheel's role in relation to Prizes is set out in Clause 6.
2. Competition Host responsibilities
2.1. Competition Hosts are solely responsible for ensuring each Competition complies with all applicable laws and requirements in every jurisdiction where offered or promoted. Within the UK this includes (but is not limited to):
- the Gambling Act 2005;
- consumer protection legislation;
- advertising and marketing standards; and
- other applicable statutory or regulatory requirements.
2.2. Competition Hosts must not use the Platform where doing so would breach law or regulatory requirements.
2.3. GiveWheel does not determine, certify or guarantee legal classification, legality, or regulatory status of any Competition and does not provide legal or regulatory advice.
2.4. Competition Hosts are responsible for keeping informed of changing requirements.
2.5. Competition Hosts are responsible for obtaining their own legal or regulatory advice where appropriate.
2.6. Any guidance, information, or links provided by GiveWheel are for general informational purposes only and do not replace the Competition Host's compliance obligations.
3. Eligibility
3.1. Competition Hosts must ensure that:
- they are at least 18 years of age;
- they have full authority to offer each Prize;
- each Prize can be lawfully awarded in each relevant jurisdiction; and
- any applicable age restrictions relating to entry or awarding a Prize are complied with at all times.
4. Entries
4.1. Competition Hosts are solely responsible for determining Competition format, including:
- entry prices;
- competition closing dates;
- skill-based questions (where applicable);
- free entry routes (where applicable); and
- any other rules or conditions governing entry.
4.2. Only eligible entries, as determined by the applicable Competition Rules, may participate in winner selection.
4.3. Where a Competition offers a free or alternative entry route, the Competition Host is solely responsible for ensuring compliance with all applicable requirements relating to that route.
5. Winner selection
5.1. Where GiveWheel provides automated winner selection tools, the Competition Host remains solely responsible for ensuring that:
- all eligible entries are included;
- winners are selected fairly and in accordance with Competition Rules; and
- competition records are retained where required by law.
5.2. GiveWheel's automated draw functionality is a technology tool and is not guaranteed to be available, uninterrupted, error-free, or suitable for every Competition.
5.3. Before running a draw, the Competition Host is solely responsible for reviewing the draw pool and draw parameters, including eligibility and weighting.
5.4. GiveWheel does not independently verify entry eligibility, completeness, accuracy, weighting, processing status, or validity before a draw.
5.5. To the extent permitted by law, GiveWheel is not responsible for loss, claim, dispute, or liability arising from error, malfunction, delay, or failure in automated draw functionality.
5.6. If the Competition Host conducts winner selection itself, it is solely responsible for fair, lawful conduct in accordance with Competition Rules.
5.7. Entries received outside the Platform (for example by post) cannot be included in GiveWheel's automated draw functionality.
5.8. Where a Competition relies on skill, knowledge or judgement, the Competition Host remains solely responsible for ensuring legal characteristics are preserved.
5.9. Winner notification and verification
5.9.1. The Competition Host is solely responsible for contacting winners, verifying eligibility, and completing all steps required to confirm winners and fulfil Competition Rules.
5.9.2. GiveWheel does not contact winners or otherwise act as the Competition Host in notifying, verifying or corresponding with winners, unless expressly agreed otherwise in writing.
5.9.3. Where permitted by Competition Rules and law, the Competition Host may select a replacement winner or otherwise reallocate the Prize in accordance with the stated process.
6. Prizes
6.1. Competition Hosts are solely responsible for:
- providing each Prize;
- arranging delivery or collection of each Prize;
- paying associated costs, including delivery, insurance, and applicable taxes; and
- resolving disputes relating to a Prize with the winning entrant.
6.2. The Competition Host must not offer a Prize unless it has the right and ability to award it in accordance with Competition Rules.
6.3. GiveWheel does not guarantee fulfilment of any Prize and has no responsibility for provision, delivery, quality, or condition.
6.4. The Competition Host warrants that each Prize corresponds materially with its description and representations.
6.5. A Competition Host may substitute a Prize only where permitted and only where substitute value is equal or greater and not materially less desirable.
6.6. Prohibited Prizes
6.6.1. The following must not be offered as a Prize:
- unlawful goods;
- counterfeit goods;
- stolen property;
- dangerous goods;
- any Prize advertised or represented in a false or misleading way; or
- any item GiveWheel reasonably considers inappropriate.
6.6.2. GiveWheel may remove or refuse to list any Prize where we reasonably believe it is prohibited or the Host lacks authority to offer it.
7. Refunds
7.1. Except where required by law or determined by the Competition Host, entries are non-refundable once submitted.
7.2. Where a refund is required by law, the Competition Host remains responsible for ensuring that it is provided.
7.3. Where funds remain held by GiveWheel, GiveWheel may process or facilitate a refund on behalf of the Competition Host in specified circumstances.
7.4. Where funds have already been paid to the Beneficiary Organisation, the Competition Host is responsible for arranging and processing refunds due.
7.5. Refunds due to entrants who entered through offline routes must be arranged and processed directly by the Competition Host.
7.6. Nothing in these Additional Terms limits or excludes any refund or remedy right an entrant may have under applicable law.
8. Cancellation
8.1. A Competition Host may only cancel a Competition where permitted by law and, where applicable, by Competition Rules.
8.2. The Competition Host must notify GiveWheel promptly of cancellation and take all required steps under law and Competition Rules.
8.3. Where a Competition is cancelled, refunds will be handled in accordance with Clause 7.
9. Changes to Competition Rules, closing dates and minimum entries
9.1. Before entries open
9.1.1. The Competition Host must clearly state Competition Rules before entries open, including closing date, entry requirements, Prize details, eligibility and conditions related to entry numbers.
9.1.2. A minimum number of entries may be set if this requirement and consequences of not reaching it are clearly stated before entries open.
9.2. After entries open
9.2.1. Once entries have opened, the Competition Host must not make material adverse changes unless the change is:
- expressly permitted by Competition Rules;
- required by law or regulatory authority;
- necessary to protect integrity, security, or proper operation; or
- otherwise permitted by applicable law.
9.2.2. A Competition Host must not cancel, extend, postpone, or materially alter a Competition solely due to lower than expected entries unless expressly permitted or otherwise lawful.
9.2.3. A Competition Host must not materially reduce Prize value, materially increase entry requirements, materially reduce winning chance, or otherwise change the fundamental basis of entry except where permitted or required by law.
9.2.4. Where a lawful change is made, affected entrants must be notified promptly and clearly, and changes applied fairly and consistently.
9.3. Where a Competition cannot continue as planned
9.3.1. Where a Competition is cancelled, does not proceed, or otherwise cannot continue, the Competition Host is responsible for compliance with Competition Rules and law, including reasonable steps to protect affected entrants and provide required refunds or remedies.
9.4. GiveWheel does not determine whether proposed Rule changes are legally permissible or fair.
10. Suspension
10.1. We may suspend entries or remove Competitions from the Platform where we reasonably believe these Additional Terms were breached or action is necessary to protect users or comply with legal obligations, including but not limited to:
- suspected illegal lottery;
- inadequate free-entry route;
- misleading prize;
- missing prize;
- fraudulent activity;
- failure to award prize;
- unlawful, misleading, or unfair cancellation, or proposed cancellation;
- materially changing rules;
- regulatory concern; or
- complaints indicating unfair treatment.
Governing Law
GiveWheel's Terms and Policies are governed by the laws of England and Wales.
Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection laws provide otherwise.
These Terms constitute the entire agreement relating to your use of the Platform.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A delay or failure by either party to enforce any provision of these Terms does not waive the right to enforce it later.
