Donations, Receipt and Disbursement Policy
This Donations, Receipt and Disbursement Policy (the "Policy") forms part of the GiveWheel Terms of Service (the "Terms") and governs your use of GiveWheel, including our website, applications, fundraising tools, ticketing services, competitions, auctions and any other products or services we provide (collectively, the "GiveWheel Services" or "Platform").
This Policy applies to each user or viewer of the GiveWheel Platform ("you" or "your").
This Policy explains how GiveWheel receives, administers, allocates, refunds and applies Donations, and how amounts become eligible for onward payment to Beneficiary Organisations.
Where this Policy conflicts with the Terms, this Policy will prevail only to the extent necessary to govern the receipt, administration, allocation, refund, disbursement or onward application of Donations. The Terms otherwise continue to apply.
Capitalised terms used in this Policy have the meanings given to them in the Terms unless otherwise defined in this Policy.

1. GiveWheel's Role
1.1. GiveWheel operates the Platform and acts as the merchant of record for Donations and other payments made through the Platform where stated.
1.2. Payments are received by GiveWheel in its own name. GiveWheel controls their administration, refund handling and onward application in accordance with the Terms and this Policy.
1.3. When a Donor selects a Beneficiary Organisation or charitable purpose, the Donor instructs GiveWheel to apply the relevant Charitable Amount for the benefit of that Beneficiary Organisation or charitable purpose in accordance with the Terms and this Policy.
1.4. GiveWheel assumes responsibility for arranging the onward payment of the relevant Charitable Amount.
1.5. Unless expressly stated otherwise, the Beneficiary Organisation is not a party to the payment contract between the Donor and GiveWheel solely because the Beneficiary Organisation is displayed or selected through the Platform.
1.6. Selection or display of a Beneficiary Organisation does not, of itself, give that Beneficiary Organisation ownership of, or an immediate proprietary interest in, the particular funds received by GiveWheel.
1.7. Selection of a Beneficiary Organisation does not, of itself, create an immediate entitlement for that Organisation to receive a Payout. An amount becomes payable to a Beneficiary Organisation only when GiveWheel has completed its applicable verification, compliance and payment checks and has confirmed the relevant amount for disbursement.
1.8. GiveWheel is not required to use the same funds received from a Donor when making an onward payment.
2. Charitable Amount
2.1. The Charitable Amount may be less than the total amount paid where the payment also includes a Ticket price, purchase amount, payment-processing charge, platform fee, optional supporter contribution or other amount separately disclosed before payment.
2.2. The amount and allocation of the Charitable Amount will be determined in accordance with the information displayed to the Donor before the Donation is confirmed.
2.3. Where a Donation includes an amount that is not part of the Charitable Amount, GiveWheel may apply, retain or pay that amount in accordance with the information disclosed before payment and the Terms.
3. Allocation of Donations
3.1. Where a Donation is made for the benefit of a single Beneficiary Organisation, the Charitable Amount will ordinarily be applied for the benefit of that Organisation, subject to the Terms and this Policy.
3.2. Where a fundraising page supports more than one Beneficiary Organisation, the Charitable Amount will be allocated:
- in accordance with the allocation settings displayed on the fundraising page;
- according to a selection made by the Donor; or
- using another allocation method clearly explained before the Donation is confirmed.
3.3. Where a campaign uses GiveWheel's DonorLed functionality, the Donor may be able to select which participating Beneficiary Organisation is to benefit from the Charitable Amount.
3.4. Allocation to a Beneficiary Organisation remains subject to GiveWheel's verification, compliance, payment and risk requirements.
4. Commitment to Charitable Application
4.1. Once a Donation has been successfully received, GiveWheel will commit an amount equal to the relevant Charitable Amount for onward application for the benefit of the selected Beneficiary Organisation or charitable purpose, subject to the Terms and this Policy.
4.2. GiveWheel's commitment under this section is subject to:
- refunds and payment reversals;
- chargebacks;
- payment-processing costs, platform fees and other deductions disclosed before payment;
- fraud prevention and investigation;
- sanctions screening and other compliance checks;
- verification of the selected Beneficiary Organisation;
- legal and regulatory requirements; and
- the other provisions of the Terms and this Policy.
4.3. The commitment described in this section does not, of itself, mean that the selected Beneficiary Organisation acquires ownership of, or an immediate proprietary interest in, the particular funds received by GiveWheel.
4.4. The commitment to apply the Charitable Amount is subject to GiveWheel being able to make the relevant Payout in accordance with the Terms, this Policy and applicable law.
5. Beneficiary Organisation Eligibility and Verification
5.1. A Beneficiary Organisation must satisfy GiveWheel's eligibility and verification requirements before it can receive a Payout.
5.2. GiveWheel may request information or documentation from a Beneficiary Organisation at any time, including information required to:
- verify its identity or charitable status;
- confirm payment information;
- comply with legal or regulatory requirements;
- prevent fraud or financial crime; or
- assess whether the fundraising activity or proposed Payout presents legal, regulatory or reputational risk.
5.3. Selection or display of a Beneficiary Organisation does not mean that GiveWheel guarantees that the Organisation will remain eligible to receive a Payout.
5.4. GiveWheel may restrict, suspend or remove a Beneficiary Organisation from the Platform where it reasonably considers this necessary for legal, regulatory, compliance, safeguarding, fraud-prevention, payment, reputational or other legitimate operational reasons.
6. Disbursement
6.1. GiveWheel ordinarily disburses eligible Donations monthly, although different payment timings may apply to Ticketed Events, Prize Competitions, Auctions, disputed transactions or arrangements agreed with a Company, Event Organiser or Beneficiary Organisation.
6.2. GiveWheel will determine the appropriate timing and method of onward payment.
6.3. A Payout may be made through Stripe, Charities Trust, another approved payment or charitable-distribution provider, or by direct bank transfer.
6.4. GiveWheel may aggregate amounts intended for the same Beneficiary Organisation and is not required to use the same funds or payment route through which the original Donation was received.
6.5. GiveWheel may delay a Payout where reasonably necessary to complete verification, compliance, fraud-prevention, sanctions, payment or other checks.
7. Where Payment Cannot Be Made
7.1. If GiveWheel cannot make a Payout to the selected Beneficiary Organisation, it will first take reasonable steps to resolve the issue.
7.2. Such steps may include:
- requesting verification or payment information;
- contacting the Beneficiary Organisation;
- allowing additional time for the Organisation to satisfy GiveWheel's requirements; or
- using an alternative payment or charitable-distribution route.
7.3. Payment may be impossible or inappropriate where the Beneficiary Organisation:
- cannot be verified;
- fails to provide suitable payment information;
- has ceased operating;
- is subject to legal, regulatory or sanctions restrictions;
- refuses the funds or reasonably objects to the fundraising activity; or
- is otherwise ineligible under GiveWheel's requirements.
7.4. Where the issue cannot reasonably be resolved, GiveWheel may:
- return the relevant amount to the Donor;
- invite the Donor or Fundraiser to select another eligible Beneficiary Organisation;
- apply the amount for the benefit of another eligible Beneficiary Organisation with the same or a materially similar charitable purpose; or
- arrange for the amount to be applied through an approved charitable-distribution partner.
7.5. GiveWheel will exercise this discretion reasonably and in good faith, having regard to the charitable purpose communicated to the Donor at the time of the Donation.
7.6. No Beneficiary Organisation acquires an entitlement to a Payout merely because a fundraising page has previously identified it as a beneficiary.
8. Addition, Restriction, and Removal of Beneficiary Organisations
8.1. GiveWheel may add, verify, restrict, suspend or remove Beneficiary Organisations from the Platform.
8.2. A Beneficiary Organisation does not acquire a right to remain listed merely because fundraising activity has previously been created for its benefit.
8.3. Removal, suspension or restriction of a Beneficiary Organisation does not, of itself, create an obligation on GiveWheel to make a Payout to that Organisation in respect of amounts that have not become payable under this Policy.
8.4. Where a Beneficiary Organisation is removed or becomes ineligible, GiveWheel will deal with relevant amounts in accordance with the provisions governing Payouts, refunds and alternative application of Charitable Amounts in this Policy.
9. Refunds
9.1. If a Donor tells GiveWheel that a Donation was made in error or without authorisation, GiveWheel will investigate the circumstances.
9.2. GiveWheel may consider or process a refund where:
- the payment was made fraudulently or without authority;
- the Donation was duplicated or made as a result of an evident technical or payment error;
- refunding the Donation is necessary for legal, regulatory, safeguarding or compliance reasons;
- the relevant Beneficiary Organisation agrees to the refund; or
- another exceptional circumstance justifies a refund.
9.3. Refund requests should be made to GiveWheel as soon as reasonably possible through our support team.
9.4. GiveWheel may consult the relevant Beneficiary Organisation before deciding whether a refund can be processed.
9.5. If the Donation has not yet been paid to the relevant Beneficiary Organisation, GiveWheel may refund the Donor directly.
9.6. Once a Donation has been paid to the relevant Beneficiary Organisation, GiveWheel has no obligation to recover or refund it, except where GiveWheel is legally responsible for the relevant loss or error. Where GiveWheel is not legally responsible for the loss or error, the Donor may need to request repayment directly from the Beneficiary Organisation.
9.7. Any refund of payment-processing charges, platform fees, optional supporter contributions or other amounts separately charged will depend on the circumstances of the refund and whether those sums are recoverable from the relevant Payment Provider or otherwise refundable.
10. Payment Processing, Charitable Distribution and Gift Aid
10.1. Donations may be processed or distributed using Payment Providers and other third-party payment or charitable-distribution providers.
10.2. GiveWheel may determine which Payment Provider or distribution route is used for a particular Donation or Payout.
10.3. GiveWheel is not required to use the same Payment Provider or payment route for the receipt of a Donation and its subsequent Payout.
10.4. GiveWheel may use Stripe, Charities Trust or another approved provider to facilitate payment or charitable distribution.
10.5. GiveWheel may provide information relating to Donations and Payouts to relevant Payment Providers and charitable-distribution providers where reasonably necessary to process payments, make Payouts, administer Gift Aid, comply with legal or regulatory requirements, prevent fraud or otherwise provide the GiveWheel Services.
10.6. Where Gift Aid applies, GiveWheel may act as a donor intermediary in relation to the relevant Donation and may collect, transmit or create Gift Aid declarations on behalf of the relevant Beneficiary Organisation in accordance with applicable HM Revenue & Customs requirements.
10.7. Gift Aid declarations and claims remain subject to the eligibility requirements and procedures applicable under HM Revenue & Customs rules. GiveWheel does not guarantee that any particular Donation will qualify for Gift Aid.
11. Changes to this Policy
11.1. GiveWheel may update this Policy from time to time in accordance with the provisions governing changes to the Terms.
11.2. The version of this Policy applicable to a Donation will generally be the version incorporated into the Terms at the time the Donation is made, subject to changes that may lawfully apply to the administration, refund or disbursement of Donations already made.
Governing Law
GiveWheel's Terms and Policies are governed by the laws of England and Wales.
Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection laws provide otherwise.
These Terms constitute the entire agreement relating to your use of the Platform.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A delay or failure by either party to enforce any provision of these Terms does not waive the right to enforce it later.
