Ticketed Events - Terms of Service

These terms and conditions ("Agreement") set forth the general terms and conditions of your use of the givewheel.com website ("Website" or "Service") and any of its related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", "you" or "your") and this Website operator ("Operator", "we", "us" or "our"). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Website and Services. You acknowledge that this Agreement is a contract between you and the Operator, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

Ticketed Fundraisings

  1. 1. All ticket sales are final unless the event is cancelled by the organiser.
    Refunds will only be issued in the event of cancellation, and GiveWheel is not responsible for any other refund requests.
  2. 2. The fundraising organiser is responsible for delivering the event as described on the fundraising page.
    Including date, time, location, and any promised benefits or experiences. Any changes to the event must be communicated promptly to ticket holders.
  3. 3. GiveWheel processes payments on behalf of the fundraiser and distributes funds to nominated charities according to the allocation specified by the organiser.
    GiveWheel does not guarantee the accuracy of allocations and relies on information provided by the organiser.
  4. 4. By purchasing a ticket or participating in a ticketed fundraising event, you agree to GiveWheel's Terms.
    See Terms of Use and Privacy Policy. You also acknowledge that GiveWheel is not responsible for the conduct, delivery, or outcome of the event.
  5. 5. Organisers must ensure that their event complies with all applicable laws and regulations.
    Including any licensing or health and safety requirements.
  6. 6. GiveWheel reserves the right to suspend or remove any fundraising event that is found to be in breach of these terms or any applicable law.

Prize Draws

  1. 1. Compliance and Legal Framework
    GiveWheel provides functionality enabling fundraisers to operate online prize competitions and free draws that fall outside the scope of regulation under the Gambling Act 2005.
    The term “raffle” is used on GiveWheel for marketing purposes only. All such activities are intended to be structured and operated as prize competitions or free draws, and not as lotteries.
    For detailed guidance on the distinction between these activities, please refer to the UK Gambling Commission at www.gamblingcommission.gov.uk.
  2. 2. Promoter Responsibility
    By creating a prize competition or free draw on GiveWheel, the fundraiser (the “organiser”) is deemed to be the promoter of that competition and bears sole responsibility for ensuring that the competition:
    • Complies in full with the Gambling Act 2005 and all other applicable laws and regulations;
    • Is operated fairly and transparently; and
    • Provides all legally required information to participants.
    GiveWheel acts solely as a technical platform provider and does not act as a promoter, operator, or agent for any competition created by users.
  3. 3. No Guarantee or Legal Advice
    GiveWheel does not provide legal, financial, or regulatory advice. While GiveWheel provides functionality designed to support lawful operation of prize competitions and free draws, it makes no warranty or guarantee that any individual competition will qualify as exempt under the Gambling Act 2005 or other applicable laws.
    It is the organiser's responsibility to obtain independent legal advice where necessary.
  4. 4. Eligibility to Create Competitions
    To create a prize competition or free draw on GiveWheel:
    • The organiser must be located in a jurisdiction where such competitions are lawful.
    • The organiser must be aged 18 or over.
    • The organiser must include a free entry route or a skill-based question, unless they hold a valid licence to operate a lottery.
    GiveWheel reserves the right to close, suspend, or cancel any competition at any time, without prior notice or explanation.
  5. 5. Entry Requirements
    Each entrant may participate in a competition by one of the following means:
    • a. Skill-based entry
      By purchasing a paid entry ticket and answering a skill-based question chosen by the organiser.
      Tickets will be issued regardless of whether the entrant answers correctly. However, only entries that answer the question correctly will be entered into the final draw.
    • b. Free entry route
      By using a free entry route made available and administered by GiveWheel, where the organiser has selected this option.
      Free and paid entries will be treated equally when selecting a winner.
    All ticket payments are non-refundable.
  6. 6. Winner Selection and Verification
    GiveWheel provides an automated winner selection tool that applies the correct eligibility rules for:
    • Skill-based competitions (including filtering for correct answers), and
    • Free draws (including equal treatment of free and paid entries).
    Organisers may alternatively choose to download entrant data and conduct their draw offline. In such cases, the organiser is solely responsible for ensuring that:
    • All entries are included and treated fairly in accordance with these terms;
    • Any skill-based eligibility conditions are correctly applied; and
    • The draw process is conducted transparently and verifiably.
  7. 7. Agreement to Terms
    By creating a prize competition or free draw fundraising page, the fundraiser agrees to be bound by these terms and GiveWheel’s general Terms and Conditions.
    By purchasing a ticket or entering a competition (including via any free entry route), each entrant agrees to be bound by these terms and GiveWheel’s general Terms and Conditions.

Auctions

  1. 1. Organiser Details
    You must be 18 or older and looking to run an auction in the UK only.
  2. 2. Your Responsibilities
    GiveWheel auctions are not run or managed by GiveWheel. GiveWheel provides a platform for organisers to create and manage their own auction listings and collect payments. As the event organiser, you are responsible for:
    • Creating accurate auction listings, including item descriptions, photos, and any conditions of sale
    • Managing communications with bidders
    • Ensuring the auction is run fairly and transparently
    • Handling delivery or collection of items directly with the buyer
  3. 3. Payment Collection
    GiveWheel will issue invoices to all winning bidders at the end of the auction. All auction payments must be collected through GiveWheel via UK bank transfer. You must not request or accept payment outside of GiveWheel. In the event a bidder refuses payment, we can issue an invoice to the next highest bidder upon request.
  4. 4. Delivery of Items
    GiveWheel has no responsibility for the delivery, quality, condition, or collection of any items sold through auctions. Organisers must manage delivery or collection directly with the buyer.
